Terms of Service

1. Agreement to Terms

By accessing or using CrowdChoose ("the Platform"), operated by Netrope PTY Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old to use CrowdChoose. By creating an account or casting a vote, you confirm that you meet this requirement. We reserve the right to terminate accounts of users who do not meet this requirement.

3. Creator Accounts

Creators are responsible for the content of their polls, including poll titles, options, reward descriptions, and reward links. You must not create polls for illegal activities, misleading content, adult content (unless your platform expressly permits it), or anything that violates applicable law.

You are responsible for ensuring your reward links remain accessible and deliver the promised content to winning voters. Failing to honour rewards may result in account suspension.

4. Votes and Payments

All votes are non-refundable. By casting a vote, the voter acknowledges that the payment is final, regardless of the poll outcome. No refunds will be issued except where required by applicable consumer law.

Payments are processed by Stripe. CrowdChoose does not store payment card details. By voting, you agree to Stripe's Terms of Service.

5. Platform Fee

CrowdChoose charges a 10% platform fee on all poll revenue. This fee is automatically deducted from each payment at the time of voting via Stripe Connect. Stripe's standard transaction fees also apply and are deducted from poll revenue.

Creators must connect a Stripe account to receive payouts. Payouts are handled by Stripe and subject to Stripe's payout timelines and policies.

6. Prohibited Uses

You must not use CrowdChoose to:

  • Create fraudulent polls intended to deceive voters
  • Collect payments without intent to deliver rewards
  • Engage in vote manipulation or use bots
  • Violate any applicable local, state, national, or international law
  • Infringe the intellectual property rights of any third party

7. Intellectual Property

You retain all rights to the content you submit to CrowdChoose. By submitting content, you grant us a limited, non-exclusive licence to display and operate your polls on the Platform. We do not claim ownership of your content.

8. Suspension and Termination

We reserve the right to suspend or terminate any account, with or without notice, that we determine in our sole discretion to be in violation of these Terms, engaging in fraudulent activity, or harmful to the Platform or its users.

9. Limitation of Liability

To the maximum extent permitted by law, Netrope PTY Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising out of or in connection with your use of the Platform.

Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount of platform fees we received from you in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
